ORDER

 

          In order to ensure preventive action to ensure conduct of peaceful, free and fair poll during the forthcoming Panchayat and Municipal Elections, the office of the Director, Panchayat and Municipal Elections being deeply aware of the increasingly vitiative role of criminality and muscle power at elections has been taking, and directing, the taking of a number of measures over and above the purview of normal law and order arrangements, for augmenting the possibilities of peaceful, free and fair poll.

          These measures include the regulation and ban on the sale of liquor in close proximity with the dates of poll and counting. Section 135C of the Representation of the People Act, 1951, provides that no spirituous, fermented or intoxicating liquors or other substances of a like nature shall be sold, given or distributed at a hotel, eating house, tavern, shop or any other place public or private, within a polling area during the period of forty eight hours ending with the hour fixed for the conclusion of poll for any election in that polling area. A special drive shall be launched to check the sale of alcohol during elections.

All the retail outlets of ANIIDCO Ltd., licenced bars, hotels, restaurants and other establishments selling/serving liquor, shall not be permitted to sell/serve liquor to anyone whosoever, on the aforesaid days in the South Andaman District and they are also directed to submit daily reports in the prescribed format showing the details of liquor sold and consumed per day in their respective shops/outlets at the District Office, South Andaman w.e.f. 27-08-2015 till completion of the Election.

The team constituted for implementation of Modal Code of Conduct are directed to keep vigil on the bars/ANIIDCO outlets under their jurisdiction and report cases of illegal sale/distribution by the candidates or political party workers.

The storage of liquor by individuals shall be curtailed during the above period and the restrictions provide in the excise-law on the storage of liquor in unlicensed premises shall be vigorously enforced.

Steps shall also be taken by the District Election Officer of North & Middle Andaman District and Nicobar District to prohibit sale of liquor in their respective Districts so that there are no chances of clandestine movement of liquor from those areas till the restriction are in operation.
